Terms of Service

1. Introduction

Welcome to Kyool.

These Terms of Service ("Terms") govern your access to and use of the Kyool website at kyool.app, the Kyool mobile app for iOS and Android (including the Kyool Apple Watch app), and any related services provided by Kyool LLC ("Kyool," "we," "our," or "us"). We refer to all of these together as the Services.

By accessing or using the Services, creating a Kyool account, or downloading the Kyool app, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Services.

Our Privacy Policy explains how we handle your information and forms part of these Terms.

2. About Kyool

Kyool is a fitness accountability platform designed to help people stay consistent through shared commitment in small private groups.

The Services may include features such as:

activity and workout tracking
accountability groups (FAB – Fitness Accountability Buddy groups)
shared streaks, missions, and goal tracking
Sparks and other social encouragement features
progress and activity analytics
optional paid features offered as Kyool Plus

We may add, change, or discontinue features over time.

3. Eligibility

You must be at least 13 years old to use the Services or create a Kyool account.

If you are under 18, you should use the Services with the involvement of a parent or legal guardian. If the law in your country sets a higher minimum age for using an online service or consenting to the processing of personal data, you must meet that higher age.

By using the Services, you represent that you meet these eligibility requirements.

4. Your Account

To use most features of the Kyool app you must create an account. You agree to:

provide accurate information and keep it up to date
keep the Apple or Google account you sign in with secure, and not share your Kyool account
be responsible for all activity that occurs under your account
notify us promptly at support@kyool.app if you believe your account has been compromised

You may delete your account at any time from Settings > Profile & Personal Details > Delete Account in the app, or through our Delete Account page.

5. Acceptable Use

You agree to use the Services only for lawful purposes.

You agree not to:

violate any laws or regulations
impersonate another person or misrepresent your identity or affiliation
attempt to gain unauthorized access to Kyool systems or another user’s account
interfere with the security, integrity, or performance of the Services
scrape, harvest, or copy content or user data without permission
use automated means to create accounts, submit content, or manipulate streaks or results
misuse communication channels such as forms, email, Sparks, or reporting tools
reverse engineer, decompile, or attempt to extract source code from the app, except where that restriction is prohibited by law

6. Community Standards and Prohibited Content

Kyool has zero tolerance for objectionable content and abusive behavior. These standards apply to everything you post, upload, send, or share through the Services, including profile details, group names and descriptions, activity notes and captions, photos, custom Sparks, journal entries, feedback, and any message to another member.

You may not post, upload, send, or share content that:

is objectionable, abusive, threatening, hateful, or harassing
bullies, intimidates, stalks, or targets any person or group
promotes hatred, discrimination, or violence against people based on race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation
is sexually explicit, pornographic, or sexually suggestive, or that sexualizes a minor in any way
depicts or promotes graphic violence, self-harm, suicide, or eating disorders
is fraudulent, deceptive, or misleading, including scams, phishing, and impersonation
is illegal, or promotes or facilitates illegal activity, including the sale of illegal or regulated goods
contains another person’s private or personal information shared without their consent
infringes anyone’s intellectual property, privacy, or other rights
contains malware, spam, or unsolicited commercial promotion
presents unsafe, extreme, or medically dangerous fitness, diet, or supplement advice

You also agree not to:

harass, threaten, or abuse other members through Sparks, group features, or any other part of the Services
encourage or coordinate abuse of another member
circumvent a block placed on you by another member
submit false or bad-faith reports

By posting content to Kyool, you confirm that it complies with these standards and that you have the right to share it.

7. Reporting Content and Blocking Members

Kyool gives every member tools to deal with content or people they find objectionable.

Reporting

You can report any member-visible content or any member directly in the app. Reporting is available on completion photos, custom Sparks, member profiles, and FAB groups. When you report, you select a reason — such as harassment, hate speech, nudity or sexual content, violence or threats, spam or scams, or self-harm — and you can add details.

You can also report content or conduct to us by email at support@kyool.app.

Blocking

You can block another member at any time from their profile or from a FAB member list. When you block someone, their content is hidden from you immediately, and the block stays in place across your devices and after reinstalling the app. You can unblock a member later if you choose.

Emergencies

Kyool is not an emergency service. If you believe someone is in immediate danger, contact your local emergency services.

8. Content Moderation and Enforcement

Kyool reviews reports of content and conduct that may violate these Terms, and we act on violations.

We review reports submitted through the app and by email, and we aim to review them promptly.
We may review, remove, restrict, or disable access to any content that we believe violates these Terms or applicable law.
We may restrict, suspend, or terminate any account that violates these Terms, and we may remove a member from a FAB group.
We may act on reports we receive, and we may take action on our own initiative when we become aware of a violation.
We may cooperate with law enforcement and respond to lawful requests where we are required or legally permitted to do so, and we may preserve or disclose content and account information where necessary to comply with the law, enforce these Terms, or protect the rights, safety, or property of Kyool, our members, or the public.
Repeated or serious violations may result in suspension or permanent termination of your account. Serious violations — including threats of violence, sexual content involving minors, and illegal content — may result in immediate termination without prior warning.

We may take action with or without prior notice, depending on the severity of the violation. Where practical and lawful, we will tell you what action we took. If you believe we acted in error, you can appeal by contacting support@kyool.app.

Kyool is not obligated to monitor all content, and we do not review every post before it appears. Our right to moderate does not create a duty to detect every violation, and we do not guarantee that we will find or remove all violating content.

9. User-Generated Content

You retain ownership of the content you create and submit to Kyool.

If you submit or upload content to Kyool (including photos, activity notes and captions, goals, group names, custom Sparks, comments, messages, or feedback), you grant Kyool a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as necessary to operate, provide, secure, and improve the Services — including displaying it to the members of the FAB groups you share it with.

This license ends when you delete the content or delete your account, except where the content has already been shared with others, or where we must retain a copy to comply with legal obligations or to enforce these Terms.

You remain responsible for the content you submit and must ensure it complies with Section 6 and does not violate any laws or third-party rights.

10. Intellectual Property

All content in the Services that is provided by Kyool is owned by Kyool or its licensors.

This includes:

the Kyool name and brand
logos and trademarks
website and app design, layout, and software
illustrations and graphics
written content
platform concepts such as FAB (Fitness Accountability Buddy)

These materials are protected by intellectual property laws.

Subject to these Terms, Kyool grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Kyool app on devices you own or control. You may not reproduce, distribute, modify, or create derivative works from Kyool content without prior written permission.

11. Feedback and Suggestions

Users may provide feedback, suggestions, or ideas regarding Kyool.

By submitting feedback to Kyool, you agree that:

the feedback is voluntary and non-confidential
Kyool may use the feedback without restriction
Kyool is not required to provide compensation or credit for such feedback

Feedback submitted through public feedback channels may be visible to other users, and must comply with the community standards in Section 6.

12. Beta Programs and Early Access

Kyool may invite users to participate in beta programs or early access features.

Beta services:

may contain bugs or errors
may change or be discontinued
may not function as expected

Beta services are provided “as is” without warranties of reliability or availability.

Participation in beta programs is voluntary.

13. HEALTH AND FITNESS DISCLAIMER

KYOOL IS NOT A MEDICAL OR HEALTHCARE PROVIDER.

THE INFORMATION AND FEATURES PROVIDED BY KYOOL ARE FOR INFORMATIONAL AND MOTIVATIONAL PURPOSES ONLY.

KYOOL DOES NOT PROVIDE:

MEDICAL ADVICE
HEALTH DIAGNOSIS
PROFESSIONAL FITNESS TRAINING

YOU SHOULD CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE BEGINNING ANY FITNESS PROGRAM.

PHYSICAL ACTIVITY INVOLVES RISKS. BY USING KYOOL, YOU ACKNOWLEDGE THAT YOU PARTICIPATE IN FITNESS ACTIVITIES AT YOUR OWN RISK.

ACTIVITY DATA SHOWN IN KYOOL, INCLUDING DATA READ FROM APPLE HEALTH, HEALTH CONNECT, OR A CONNECTED DEVICE, IS AN ESTIMATE AND SHOULD NOT BE RELIED ON FOR MEDICAL PURPOSES.

14. Accountability Groups and User Interactions

Kyool enables members to interact with others through features such as FAB (Fitness Accountability Buddy) groups, Sparks, and shared activity.

Kyool does operate the moderation program described in Sections 6 to 8: we set community standards, we provide reporting and blocking tools, we review reports, and we act on violations of these Terms, up to and including removing content and terminating accounts.

At the same time, you should understand the limits of what we can do. Kyool does not perform background checks on members, and does not independently verify a member’s identity, qualifications, or the accuracy of any fitness advice they give. We cannot review every post before it appears, and we cannot guarantee the conduct of any member.

You are responsible for how you interact with other members, and Kyool is not liable for the conduct, advice, or actions of other users. Please use good judgment, especially when joining a group with people you do not already know, and report anyone who violates these Terms.

15. Third-Party Services

The Services may link to or integrate with third-party websites and services, including app stores, sign-in providers, and connected fitness accounts.

These services operate independently and have their own terms and privacy policies.

Kyool is not responsible for third-party content or practices.

16. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

Kyool makes no warranties regarding:

uninterrupted availability
accuracy of information or activity measurements
security of the Services
reliability of services

Use of the Services is at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, Kyool shall not be liable for any indirect, incidental, or consequential damages resulting from:

use of, or inability to access, the Services
reliance on content in the Services
fitness activities related to Kyool services
the conduct or content of other users

Kyool’s total liability to you for any claims arising from these Terms shall not exceed $100 USD or the amount you paid Kyool in the previous 12 months, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnification

You agree to indemnify and hold harmless Kyool and its affiliates from any claims, damages, or legal expenses arising from:

your use of the Services
violation of these Terms
content you submit to the platform
interactions with other users

19. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

You agree that disputes will be resolved on an individual basis, and you waive the right to participate in class actions or class-wide arbitration, except where such a waiver is unenforceable under applicable law.

Where a dispute is not subject to arbitration under this section — including where arbitration or the waiver above is prohibited or unenforceable under applicable law — that dispute will be resolved in the courts identified in Section 22 (Governing Law).

20. Termination

You may stop using the Services at any time and may delete your account as described in Section 4.

Kyool may suspend or terminate your access to the Services if you violate these Terms, as described in Section 8, or if we are required to do so by law.

Deleting your Kyool account does not cancel an active App Store or Google Play subscription. You must cancel a subscription through your Apple or Google account settings.

21. Changes to These Terms

Kyool may update these Terms from time to time.

When updates occur, the revised Terms will be posted on this page with an updated "Last Updated" date.

Continued use of the Services after updates indicates acceptance of the revised Terms.

22. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Subject to any applicable arbitration provisions, disputes arising out of or relating to these Terms or the Kyool Services will be brought in the state or federal courts located in Virginia, and you consent to the jurisdiction of those courts.

Applicable consumer protection laws in your country of residence may also apply, and nothing in this section deprives you of the protection of mandatory provisions of the law of the country where you live.
